Default Buying a car without a logbook?

Right, I've just agreed to buy an xr3i cabby thats got some running issues (its had an RST lump fitted, but its not running right )
The mechanic who was employed to get it runnin is selling it, as the guy who owned it has left it there for 2 years and not paid the bills for parts used/ labour etc. He only wants £400 to cover what he's paid out in time and parts (new set of sensors and a new ecu amongst other bits).
Its worth the money all day long, but can the guy who has the original log book claim the car off me if I buy it or block my application for the paperwork?

When you apply for a duplicate V.5, DVLA will contact the last recorded keeper.
He probably won't be pleased.

I will get a letter, if he does not reply to it stating he still owns the car then you will be issued the log book.

I would apply before I paid the full amount and collected the car.

Or, just buy it and break it, after all, he may turn up one night and take it back

he cant do fook all mate

ive just done the same with a vr6 golf bought it off a garage the previous owner still had log book etc,i applied for log book and recieved it within 4 days now the cars all mine
