what rights do the owners have

had a row with the manager of the little chef at the half way house (essex meet)

he was claiming that he was gonna tow my truck away and get it impounded

there is no signs to state anything of the sort, not that i could see and i did have a good look before i went spastic at him

just need to know for sure so i can park there tomoz and really go into one at him again

If it's private land (which terchnically it is) he can clamp you and there's fuck all you or the Law can do about it.

Nah mate, thats easily sorted - just go into the Little Chef and buy something... Even if it's just a cup of tea. Get a reciept. You are now a patron of that estabilshment and are entitled to use the car park

He needs a license and signs before he can even THINK about clamping as it is regulated now, if the cart park is at a little chef ONLY, he is within his rights to ask you to move.
However if you do not move it is a CIVIL Offence not one of trespass, as you did not have to go through any gated access and moved nothing out of the way to gain entry, I had this almost every week with the MOD police, proved my case about PRIVATE PROPERTY access now they don't bother, jesus I was only taking piccies of aircraft.
For any place to be IN LAW PRIVATE, there has to be PHYSICAL barriers, gates fence etc there for at least 24 consecutive hours in every year, private property signs in law have no meaning unless you have to remove something blocking your way such as a gate etc.

So long as you don't mind him parking up in your drive, he should be happy to let you use his car park.

And I'm sure that he won't mind paying business rates on the bit of space that you are using either! It's not like you are stopping paying customers from using the space or anything, is it?

i think you should park your rig rite in front so that no one can even see it!! they charged me feckin 9 quid for a breakfast the other wk!!

To be able to clamp he must have adequate signs up telling people unauthorised vehicles are liable to clamping and on the same signs must be details of the release fee, contact details and the VAT registration number. If there are no signs up then as with the gypo's there really isn't anything much he can do other than make a lot of noise
